We represented a dentist in a malpractice claim venued in the New York Supreme Court, Kings County. The claim alleged improper extractions and the negligent placement of implants and bridgework, resulting in implant failure, infections, bone loss, and the need for full upper and lower arch rehabilitation. The case was brought against several dentists who were following one treatment plan. The Court accepted LCBF’s argument that our dentist’s extraction of two of Plaintiff’s natural maxillary teeth and implant placement were at all times in accordance with good and accepted standards of dental care and that the treatment did not cause or contribute to any of Plaintiff’s alleged injuries. The Court also accepted LCBF’s argument that Plaintiff’s expert failed to show a departure from the standard of care that would make the implants a proximate cause of Plaintiff’s alleged injuries. Ultimately, the Court agreed that our client was merely a specialist who served as one component in Plaintiff’s larger dental treatment and therefore dismissed our client from the case, overcoming the high threshold for summary judgment motions under New York law.
