LCBF secured a complete dismissal of a retaliation complaint filed against our client at the New York State Division of Human Rights. The employee alleged that the client had terminated his employment in retaliation for a prior racial discrimination complaint he had filed with the Division three months prior. Following a full administrative hearing, held three years after the retaliation complaint was initially filed, an administrative law judge ruled that although the employee had established a prima facie case of discrimination, LCBF proved through its presentation of witnesses and documentary evidence that the client terminated the employee for legitimate non-retaliatory reasons unrelated to his discrimination complaint.
