LCBF represented subcontractors in two separate lawsuits related to the habitability of an apartment, filed in New York County Supreme Court. Plaintiffs’ causes of action included breach of contract, nuisance, implied warranty of habitability, covenant of quiet enjoyment, negligence, personal injury, property damage, fraud, and toxic tort. LCBF obtained complete dismissals of third-party complaints filed by a general contractor against our clients. LCBF filed pre-discovery motions to dismiss the complaints. Our motion and argument focused on the Defendant’s inexcusable delay in filing the third-party complaints and highlighted the undue prejudice to our clients caused by the delay. The Court agreed with LCBF and held that both third-party complaints should be dismissed. The litigation team was led by Daniel Moretti and Nakia Small.
