LCBF obtained summary judgment in a snow and ice slip and fall case that occurred on a sidewalk driveway in Manhattan. Plaintiff alleged that LCBF’s client was responsible for maintaining the sidewalk driveway. LCBF successfully argued that it was not responsible for Plaintiff’s injuries because 1) a storm was in progress at the time of Plaintiff’s fall, and 2) LCBF’s client did not own the premises and any special use it made of the premises was not a proximate cause of plaintiff’s accident. Plaintiff filed a motion to reargue the decision, which was denied.
