LCBF represents a transportation company and its employee in litigation arising from a motor vehicle accident. Through the course of discovery, plaintiff attempted to obtain information related to an unrelated disability of the employee. LCBF declined production of records related to the disability and objected to same. Plaintiff filed a motion to compel, which LCBF opposed with a cross motion for a protective order. Despite the typical permissibility of expansive discovery under New Jersey law, the defense team successfully argued that the discovery at issue ran afoul of even that permissive scope of discovery and was harassing in nature. In ruling in favor of the employee, the Court agreed that the requested records were irrelevant to the subject matter of the lawsuit and immaterial to any issue in dispute. The Court also agreed with LCBF’s arguments related to the privacy interests of the employee. The defense team was led by Fabiola Vieites, Matthew T. Degenhardt and Dina M. Carlozzi.
