LCBF successfully defended a home health care agency and a home health aide in a wrongful death claim based upon allegations of negligence and intentional conduct. Plaintiff alleged that our clients caused physical and emotional injuries that resulted in decedent’s untimely death. During the course of the three-week trial, fourteen witnesses testified. The LCBF defense team was able to elicit testimony and produce evidence that raised numerous credibility issues and inconsistencies with plaintiff’s theories of liability. Plaintiff requested $3.5M in damages during closing arguments. The jury returned a unanimous defense verdict on March 13, 2026.
