We represented a Certified Public Accountant in a claim alleging malpractice in the Superior Court of New Jersey. LCBF had previously secured dismissal of the same Plaintiff’s claims against the same clients and prevailed against him after an appeal. Upon Plaintiff’s attempt to reframe the claims and file a new action, our team immediately filed for dismissal. The Court agreed with LCBF that the case was subject to dismissal based on the entire-controversy doctrine and rejected the Plaintiff’s efforts to recast his prior claims as new claims. The Court therefore dismissed the complaint with prejudice and awarded our client the full amount of LCBF’s fees associated with filing the motion to dismiss.
